BLE UP Southern Region LERB POLICY
It has been the policy of our Committee to either appeal all the LERB cases involving decertification or to notify the employee of our intent not to do the same informing him/her of their ability to pursue their own case and offering examples of the LERB format to assist him in that appeal. Additionally, it is our policy to offer the Local Chairmen a delegate day’s pay for writing or attempting to write the appeal on behalf of his member with the understanding that the same will be forwarded to our office for final review before it is submitted to be sure that all bases have been covered.
This policy has provided three benefits to our organization. 1st – it has placed the local chairman directly in the loop and given him hands on experience of handling the grievance at the escalated level continuing the learning process regarding how our industry operates at this level 2nd - you sometimes get a very detailed description of the incident that contains little nuances unavailable to anyone who does not regularly work at that location. 3rd – I have found that issuing the LERB appeals in the local chairman’s name lends to better success rate. I firmly believe that I could submit the same LERB under an LC’s name and my name and get different results. The LERB seems to be more sympathetic to an appeal filed by the local chairman vs coming from a general chairman. The real objective is to win the case, not worry about who got credit for preparing the same.
